Terms and conditions

These General Terms and Conditions of Sale ("Terms and Conditions") apply to all bookings made with OxySki for ski and snowboard lessons, equipment rental, chalet fitting and related services.

By making a booking, the Customer confirms that they have read, understood and accepted these Terms and Conditions.

1. General provisions

1.1 Scope

These Terms and Conditions apply to all bookings for ski and/or snowboard lessons ("Lessons"), together with any additional services that may be offered, such as meals, ski passes or other related services ("Additional Services").

Lessons and Additional Services are collectively referred to as the "Services".

The Services are described on the OxySki website at https://oxyski.com (the "Website").

1.2 OxySki and the ski schools

The Services are provided and/or marketed by the relevant company within the OxySki group operating in the resort concerned.

OxySki operates as a brand under which independent professional ski and snowboard instructors provide their services.

For Lessons, the relevant company acts as an agent for these independent instructors. The instructors are independent professionals, registered with URSSAF and holding their own professional civil liability insurance. They are solely responsible for the delivery of the Lessons.

The relevant company may also market Additional Services in its own name.

The legal identity, registered office and registration details of the company contracting with the Customer are provided during the booking process and/or on the relevant booking documentation.

1.3 Regulatory authorisations

The relevant ski schools hold the regulatory authorisations required to operate their activities in their respective resorts.

1.4 Acceptance of these Terms and Conditions

Any booking or order for Services constitutes the Customer's express acceptance of these Terms and Conditions.

These Terms and Conditions are available at the Company's premises, on the Website and/or are provided to the Customer before the booking is confirmed.

The information contained in these Terms and Conditions, together with the information provided on the Website, constitutes the pre-contractual information provided to the Customer in accordance with Articles L111-1 et seq. of the French Consumer Code.

These Terms and Conditions take precedence over any other terms unless expressly agreed otherwise in writing.

2. Services

These Terms and Conditions apply to:

ski and snowboard lessons provided individually or in groups by professional instructors;

private and bespoke lessons;

group lessons;

other ski and snowboard instructional activities offered by OxySki;

Additional Services, including meals and ski passes where offered;

equipment rental;

chalet fitting and equipment delivery services.

The exact Services available, their duration, location, prices and conditions are those displayed at the time of booking.

3. Booking and contract

3.1 Making a booking

A Customer may make a booking:

by email;

by telephone;

directly at an OxySki office or shop; or

through the Website or applicable online booking system.

For online bookings, the Customer selects the required Services and adds them to their basket.

Before confirming the order, the Customer is shown a summary of the selected Services, prices and personal information provided. The Customer may correct any information before validating the order.

By validating the order, the Customer enters into an obligation to purchase and pay for the Services.

The Customer confirms that they are the holder of, or are authorised to use, the payment method provided.

Orders exceeding €120 may be archived by the Company in accordance with applicable legal requirements. The Customer may request access to the archived order by contacting the relevant Company.

Once the order has been placed, an acknowledgement and/or booking confirmation will be sent to the email address provided by the Customer.

A booking is only considered final and the Services reserved once the required payment has been received.

3.2 Contract

These Terms and Conditions, together with the Customer's booking and the applicable payment, form the contract between the Customer and the relevant Company (the "Contract").

The Contract applies for the duration of the Services stated in the booking.

4. Prices and payment

4.1 Prices

Prices are stated in euros and are those applicable at the time the booking is made.

Unless otherwise indicated:

prices for Lessons are subject to the applicable tax treatment;

prices for Additional Services include applicable taxes.

Prices may be amended without notice in the event of price increases imposed by suppliers or significant economic changes.

Any such changes will not apply to Contracts already concluded with the Customer.

4.2 Payment

Unless otherwise agreed, the total price of the Services must be paid at the time of booking.

Where a deposit or partial payment is accepted, the remaining balance must be paid in full no later than 30 days before the start of the Services.

The booking will only be confirmed once the required payment has been received.

Payment may be made using the payment methods offered during the booking process, including credit card, bank transfer, cheque or cash where available.

If the Customer fails to pay the outstanding balance by the required deadline, the School reserves the right to cancel the booking, release the reserved places and retain the deposit already paid.

5. Changes to a booking

Due to the organisation and planning required to provide the Services, bookings cannot be modified during the 30 days immediately preceding the start of the Services.

Before this 30-day period, the Customer may request changes to:

the time of the Services;

the number of participants;

the participant's level; or

other booking details.

All changes are subject to availability.

Any additional cost resulting from a requested change will be communicated to the Customer before the change is confirmed.

OxySki reserves the right to refuse a requested change where it cannot reasonably be accommodated.

6. Cancellation

6.1 Cancellation by the Customer

Except in cases of force majeure recognised under French law:

if the Customer cancels at least 30 days before the start of the Services, all amounts paid will be refunded, less any non-refundable costs already incurred, including ski passes where applicable;

if the Customer cancels less than 30 days before the start of the Services, no refund will be due.

Cancellation must be notified to the relevant Company.

For bookings made directly in resort, cancellation is non-refundable and any postponement remains at the discretion of OxySki management.

6.2 Cancellation by OxySki

If the relevant School and/or Company cancels the Services:

more than one month before the start of the Services, the deposit paid will be refunded;

less than one month before the start of the Services, the total amount actually paid for the Services will be refunded.

However, the following specific provisions apply:

Insufficient participants

If a group lesson cannot operate because there are insufficient participants, OxySki may offer either:

a refund; or

conversion to a private lesson or alternative service of equivalent value,

subject to availability and Customer agreement.

Instructor illness or injury

If an instructor is unable to provide the Services because of illness or injury, the Customer will be refunded the amounts actually paid for the affected Services. No additional compensation will be payable.

Force majeure

In the event of force majeure as recognised under French law, the relevant Company, School and/or instructors will not be liable for failure or delay in performing the Services.

The Customer will be entitled only to any refund expressly required by applicable law or these Terms and Conditions.

Weather and snow conditions

Skiing and snowboarding are weather-dependent activities.

Insufficient snow, excessive snow, piste closures, adverse weather or conditions presenting a safety risk may result in changes to the Services.

Weather or snow conditions do not automatically entitle the Customer to a refund, discount or compensation.

Customers are advised to take out suitable snow, cancellation and/or travel insurance.

7. Liability and force majeure

7.1 Lessons

The Customer acknowledges that Lessons are provided by independent professional ski and snowboard instructors.

The relevant Company acts as an agent for these instructors, who are solely responsible for the delivery of their Lessons and hold their own professional civil liability insurance.

Neither the School, the Company nor the instructor shall be liable for changes to the Lessons reasonably required because of:

safety considerations;

weather or snow conditions;

piste or lift closures;

the Customer's technical ability;

the Customer's physical condition; or

other circumstances affecting the safe delivery of the Services.

7.2 Additional Services

The relevant Company is responsible for the proper performance of Additional Services that it sells directly.

Where an Additional Service is provided by a third-party supplier, that supplier remains responsible for the performance of its own service, subject to applicable law.

7.3 Force majeure and third parties

Neither the Company, School nor instructors shall be liable for failure or delay in performing the Services resulting from force majeure.

They shall also not be liable for acts or omissions of a third party not involved in providing the Services, or for improper performance attributable to the Customer.

8. Performance of the Services

The Customer must arrive at the meeting point at the date and time stated on their booking confirmation or otherwise communicated by OxySki.

Customers arriving late cannot claim a partial refund or extension of the Lesson.

Interruptions to ski lifts or other infrastructure outside OxySki's control that affect the delivery of the Services will not give rise to a refund or compensation.

Customers acknowledge that weather and snow conditions are outside OxySki's control.

9. Group lessons

The maximum number of participants in group lessons is:

In exceptional circumstances, a group may temporarily exceed these numbers.

This may occur, for example, where:

an instructor is ill or injured and participants need to be transferred to another group;

a participant's actual level differs from the level stated at the time of booking;

a participant needs to move to a higher or lower level for technical or safety reasons;

fatigue or stress requires a participant to move to another group; or

groups with comparable technical levels need to be combined because of low participant numbers.

OxySki will make every reasonable effort to return groups to their standard size as soon as possible.

A temporary increase in group size does not entitle the Customer to a discount, refund or compensation.

To ensure the safety and experience of all participants, OxySki reserves the right to adjust or cancel a group booking if the participant's actual level is not compatible with the level indicated at the time of booking.

10. Helmet and safety equipment

Because skiing and snowboarding involve inherent risks:

helmets are compulsory for children under 13;

helmets are compulsory for all snowboard lessons, regardless of age;

helmet use is strongly recommended for all participants;

back protection is recommended for children;

wrist protection and padded shorts are recommended for snowboarders.

Customers are responsible for ensuring that their equipment is suitable and correctly used.

11. Insurance

Customers are not covered by the School's or Company's civil liability insurance for the risks inherent in participating in skiing or snowboarding activities.

Customers are responsible for taking out appropriate insurance covering, where applicable:

accident and injury;

medical and rescue costs;

cancellation;

holiday interruption;

loss or theft of personal belongings;

ski and snowboard equipment; and

unused Lessons or other Services.

Ski insurance may be available for purchase through the relevant OxySki location or insurance partner.

12. Interruption of Services following an accident

Services are non-refundable if the Customer suffers an accident, illness or other personal circumstance which prevents them from using the Services after the booking has been made.

Customers are responsible for taking out suitable cancellation and/or holiday insurance.

At the Customer's request, OxySki may provide reasonable supporting documentation to assist with an insurance claim where an accident occurs during the Services.

13. Photos and videos

By participating in the Services, the Customer accepts that they may appear in photographs or videos taken by OxySki, its Schools or instructors for promotional purposes, including brochures, websites and social media.

Customers who do not wish to appear in such material must notify the relevant Company in writing.

Following a valid refusal, OxySki will not knowingly use the Customer's image for promotional purposes and will take reasonable steps to remove previously published material where technically possible.

14. No waiver and amendments

Failure by either party to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or prevent its subsequent enforcement.

OxySki may modify or update these Terms and Conditions from time to time.

Any amendment will not apply retrospectively to Services arising from bookings confirmed before the amendment came into effect, unless required by law.

15. Right of withdrawal

The Customer is reminded that, under Article L.121-21-8 of the French Consumer Code, the statutory right of withdrawal does not apply to certain leisure services which must be provided on a specified date or during a specified period.

Ski and snowboard Lessons and other leisure Services booked for specific dates may therefore be excluded from the statutory withdrawal period.

16. Personal information

Customer personal data is processed for the purposes of managing bookings, providing Services, communicating with Customers and fulfilling OxySki's legal and contractual obligations.

In accordance with applicable French and European data protection legislation, Customers have rights relating to their personal data, including rights of access, rectification, deletion and objection where applicable.

17. Complaints and mediation

Any complaint concerning non-performance or poor performance of the Contract should first be submitted to the relevant Company in writing.

The complaint should include:

the Customer's name and contact details;

booking reference;

date and location of the Services;

a description of the issue; and

any relevant supporting documentation.

The Company will use its best efforts to respond within three weeks of receiving the complaint.

If no amicable resolution can be reached, the Customer may, where applicable, use the contractual consumer mediation procedure.

Any request for mediation should include the information required by the relevant mediator, including the Customer's contact details, the identity and address of the Company, a summary of the dispute and evidence that the Customer has first attempted to resolve the matter directly with the Company.

18. Applicable law and jurisdiction

The Contract is governed by French law.

The parties shall first make every effort to resolve amicably any dispute concerning the validity, interpretation, performance or termination of the Contract.

If an amicable resolution cannot be reached, any dispute shall be submitted to the competent courts in accordance with applicable French law and consumer protection rules.

PART II – EQUIPMENT RENTAL

19. General rental conditions

These provisions apply to all ski and snowboard equipment rented from an OxySki shop or through OxySki's chalet fitting service.

The Customer confirms that the equipment has been inspected, or that they have had the opportunity to inspect it, and accepts it as being in good working condition when it is provided.

All rental equipment is checked by OxySki before being handed over to the Customer.

19.1 Identification of equipment

Rental equipment may be numbered, labelled or otherwise marked for identification.

The equipment must be returned with the same identification number or marking.

The Customer may not lend, transfer, sub-rent or otherwise allow another person to use the equipment without OxySki's prior agreement.

19.2 Customer's responsibility

From the time the equipment is handed over or delivered until it is returned to OxySki, the Customer is responsible for its care and safe custody.

The Customer must take all reasonable precautions to prevent:

theft;

loss;

damage;

misuse; and

unauthorised use.

Equipment must be returned in substantially the same condition in which it was received, allowing for normal wear and tear.

19.3 Damage

All equipment will be inspected when returned.

If equipment has been damaged beyond normal wear and tear, the Customer may be required to pay the reasonable cost of repair.

Where equipment is damaged beyond economical repair, the Customer may be liable for the applicable replacement cost.

Where legally permitted, any amount due may be charged to the payment card provided by the Customer.

The original rental charge remains payable.

Where a theft and damage guarantee has been purchased, the applicable guarantee conditions and limits will apply.

19.4 Theft or loss

The Customer is fully responsible for rented equipment which is lost or stolen unless an applicable theft and/or damage guarantee has been purchased.

Where required by OxySki, the Customer must provide a police or gendarmerie report confirming the theft or loss.

Failure to provide the required report may result in the Customer being charged for the equipment.

19.5 Rental period

The rental period begins when the Customer takes possession of the equipment and ends when the equipment is returned.

Each rental day is charged according to the prices and conditions displayed at the time of booking.

The equipment must be returned by the agreed date and time.

OxySki may request the immediate return of equipment where necessary.

19.6 Deposit and identification

A valid payment card is required for equipment rental.

A security deposit or card guarantee may be required.

The security deposit does not represent the value of the rented equipment; it is held solely as security for the Customer's obligations under the rental agreement.

OxySki may request valid proof of identity before releasing equipment.

20. Theft and damage guarantees

Where available, Customers may purchase an optional theft and damage guarantee.

The guarantee is subject to the conditions and limits applicable to the relevant resort and equipment range.

Val d'Isère

The theft and damage guarantee costs €2.50 per person per day.

With the guarantee, the following amounts are payable in the event of theft or damage:

Without the guarantee, the following amounts are payable in the event of theft or damage:

PART III – CHALET FITTING AND EQUIPMENT DELIVERY

21. Chalet fitting service

OxySki's chalet fitting service allows Customers to book ski and snowboard equipment and have it delivered directly to their accommodation.

Depending on the resort and booking, the service may include:

delivery of equipment to the Customer's accommodation;

fitting of skis, snowboards and boots;

boot fitting and equipment adjustments;

advice on equipment selection;

equipment exchanges or adjustments where required and available; and

collection of equipment at the end of the rental period.

The exact services available may vary depending on the resort, accommodation and booking.

22. Booking and information required

To provide the chalet fitting service, the Customer may be required to provide:

the accommodation name and address;

arrival date;

estimated arrival time;

contact telephone number;

shoe and boot size;

height;

weight;

age;

skiing or snowboarding ability; and

any specific equipment requirements.

The Customer is responsible for ensuring that all information provided is accurate.

Incorrect or incomplete information may affect the fitting, equipment selection or delivery of the equipment.

23. Delivery and fitting

OxySki will make reasonable efforts to deliver equipment within the agreed delivery window.

Delivery times may be affected by:

traffic;

weather;

road conditions;

delays in the Customer's arrival;

access restrictions at the accommodation; or

other circumstances outside OxySki's reasonable control.

The Customer must ensure that OxySki's team can reasonably access the accommodation for delivery and fitting.

Where the accommodation has restricted access, reception procedures, security requirements or other access arrangements, the Customer must provide the relevant information in advance.

OxySki cannot be held responsible for delays caused by the Customer's failure to provide accurate access information or access to the accommodation.

24. Equipment fitting and exchanges

OxySki's technicians will make reasonable efforts to ensure that the equipment is correctly fitted based on the information provided by the Customer and their requirements.

The Customer must inform the technician immediately if:

boots are uncomfortable;

equipment does not fit correctly;

the equipment appears unsuitable;

an adjustment is required; or

another item is required.

Where reasonably possible, OxySki may arrange an adjustment or equipment exchange.

All exchanges are subject to availability.

The Customer must not make technical adjustments to bindings or other safety-critical equipment themselves.

25. Collection and return of equipment

At the end of the rental period, equipment must be returned in accordance with the arrangements agreed with OxySki.

Where collection has been arranged, the Customer must leave the equipment at the agreed location and ensure that it is accessible to OxySki's team.
